This Healthcare Provider Agreement governs your use of BluemoonGateway.com as a healthcare provider. By creating an account, checking the acceptance box, or using our website and services, you agree to this Healthcare Provider Agreement.
1. Purpose of Our Services
BluemoonGateway.com provides technology and payment-related services that help healthcare providers manage payments for uninsured services, including one-time payments and subscriptions. BluemoonGateway.com does not provide medical care, treatment, diagnosis, legal advice, tax advice, or accounting advice.
2. Pay-As-You-Go Service
BluemoonGateway.com is offered on a pay-as-you-go basis. There is no fixed-term commitment unless we separately agree otherwise in writing. You may stop using the services at any time, subject to this Healthcare Provider Agreement and any legal or operational requirements that continue after account closure.
3. Your Professional Responsibility
You are solely responsible for your medical practice, including the services you offer, the fees you charge, your communications with patients, and your compliance with applicable professional, billing, privacy, and recordkeeping requirements.
You are also responsible for ensuring that patients are informed of any fees or charges processed through BluemoonGateway.com and, where applicable, that any necessary patient consent to such payments is obtained.
You are responsible for handling patient information made available through your use of the services responsibly and in accordance with your professional and privacy obligations.
If you authorize a clinic administrator, staff member, or other representative to access or use BluemoonGateway.com on your behalf, you remain responsible for their use of the services in connection with your account.
4. Patient List and Required Information
BluemoonGateway.com may require limited patient identification and contact information from your EMR or other records in order to provide its payment-related services for your practice. You are responsible for any permissions, consents, or notices that may be required to share that information with BluemoonGateway.com.
5. Our Role in Handling Information
BluemoonGateway.com provides technology services that support your practice in managing payments and related account functions. We use the information you provide only to operate, support, secure, maintain, and administer the services we provide to you, and as otherwise permitted or required by law.
6. System Fees and Service Charges
BluemoonGateway.com charges transaction and/or system fees for use of the services. These system fees are disclosed within your provider profile or otherwise through the website. By using the services, you acknowledge and accept the applicable system fees.
These system fees are deducted from payments you receive from patients and are not added on top of the service price shown to patients. We may update our system fees from time to time by giving notice through the website or by electronic communication. Any changes will remain fair and commercially reasonable.
Service and subscription charges offered through the website are set by you or by an authorized clinic administrator acting on your behalf. BluemoonGateway.com does not set, control, or assume responsibility for the service or subscription charges applied to patients through the website.
7. Stripe and Payment Processing
Payment processing services are provided through Stripe and related payment service providers. Your use of payment processing features may also be subject to Stripe’s terms, policies, onboarding requirements, and compliance rules. You are responsible for maintaining any required Stripe account and information needed to receive payments.
BluemoonGateway.com is not responsible for delays, holds, reserves, reversals, or other actions taken by Stripe, card networks, or financial institutions. Payment information is entered directly into Stripe’s secure payment interface, and BluemoonGateway.com does not receive or store patients’ full payment card information.
8. Privacy and Security
BluemoonGateway.com uses reasonable administrative, technical, and physical safeguards to protect information handled through the website. You are responsible for maintaining the confidentiality of your login credentials and for controlling access to your account within your clinic or practice.
You must notify us promptly if you believe your account, patient list, or related information has been accessed or shared without authorization.
9. Data Retention, Closure, and Deletion Requests
Because BluemoonGateway.com is a pay-as-you-go service, account closure or data deletion will not be assumed simply because your account becomes inactive.
If you want to close your account or request deletion of data associated with your provider account, you must send a written request to BluemoonGateway.com.
After receiving your written request, we will take reasonable steps to close or deactivate your account and delete or limit access to data where appropriate. However, BluemoonGateway.com may retain payment, transaction, account, tax, and related business records for as long as reasonably necessary for internal recordkeeping, accounting, security, backup, and archival purposes, or as otherwise required by law.
Where deletion is not immediately possible, we will limit further active use of the information except as required for the purposes above.
10. Accuracy of Information
You are responsible for the accuracy of the information you provide to BluemoonGateway.com, including your practice details, service pricing, patient contact information, and other account-related information required for the services.
11. Communications
You consent to receive communications from us electronically, including emails, notices, alerts, and messages through the website. These communications may include important information about your account, payments, fee changes, service updates, and compliance-related matters. You are responsible for reviewing and retaining copies of any communications for your records.
12. Suspension or Termination by BluemoonGateway.com

13. Liability

You agree to indemnify and hold harmless BluemoonGateway.com, its officers, directors, employees, and affiliates from claims, losses, liabilities, damages, and reasonable costs arising from your use of the services, your healthcare services or fees, the information you provide to us, your communications or dealings with patients, or your breach of this Healthcare Provider Agreement.
14. Changes to This Agreement
We may update this Healthcare Provider Agreement from time to time to reflect changes to our services, operations, or legal requirements. If we make material changes, we will provide notice through the website or by electronic communication. Your continued use of the services after the updated version takes effect means you accept the revised Healthcare Provider Agreement.
15. Governing Documents

16. Governing Law
This Healthcare Provider Agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario, unless another governing law is required by applicable law.

2. Administrative Responsibility
You are responsible for your use of BluemoonGateway.com and for ensuring that your actions on the website are accurate, appropriate, and consistent with your clinic’s internal policies and authorizations.
If you request, process, or assist with payments on behalf of a doctor or clinic, you are responsible for doing so only as authorized by the applicable doctor or clinic.
3. Information Handling and Privacy
You agree to handle doctor and patient information responsibly and in accordance with applicable privacy requirements and your clinic’s internal policies.
BluemoonGateway.com may require limited doctor, clinic, patient identification, and contact information in order to provide its services. If you upload or provide such information through the website, you are responsible for any permissions, consents, or notices that may be required for doing so.
4. Account Security
Your login credentials are intended for your individual use. You are responsible for maintaining the confidentiality of your login credentials and for limiting access to authorized personnel within your clinic.
If you choose to share access or allow another person to use your credentials, you remain responsible for all actions taken under your account.

Blue Moon Gateway does not provide legal, medical, tax, accounting, or financial advice. It is your responsibility to consult appropriate professionals where needed in relation to your clinic’s operations and use of the website.
